1. Agreement to These Terms

These Terms of Service ("Terms") govern your use of Nova: Fitness & Habit Tracker ("Nova", "we", "our", "us"), developed and operated by NOVASTORE (PTY) LTD. By downloading, accessing, or using Nova, you agree to these Terms.

2. Health and Safety Disclaimer

Nova provides fitness tracking, workout logging, habit tracking, and gamified progress features for informational and motivational purposes only.

Nova is not medical advice and is not a substitute for professional medical advice, diagnosis, treatment, or consultation with a qualified healthcare provider.

You should consult a physician or qualified healthcare professional before starting a new exercise, fitness, nutrition, or wellness program, especially if you have a medical condition, injury, or health concern.

3. Eligibility and Accounts

• You must be at least 13 years old to use Nova.
• If you are under the age of majority in your region, you should use Nova only with permission from a parent or legal guardian.
• In certain jurisdictions, Nova uses the Google Play Age Signals API. If the system detects you are a minor, certain features (like personalized ads or in-app purchases) may be automatically restricted or disabled.
• You agree to provide accurate and truthful information when using Nova.
• You are responsible for maintaining the security of your Google Sign-In account and any activity connected to your Nova account.

4. App Features

Nova may include features such as workout logging, workout planning, daily quests, fitness goals, habit tracking, streaks, Nova XP, rankings, friend features, profile customization, rewards, and progress tracking.

Features may change over time as we improve, update, or modify the app.

5. Nova Points and Digital Items

• Nova Points and similar in-app rewards are virtual items used only inside Nova.
• Nova Points have no real-world cash value.
• Nova Points cannot be redeemed for money, transferred, sold, or exchanged outside the app.
• Digital items such as titles, portraits, borders, or other customization items are licensed for use inside Nova and are not owned as physical or monetary property.
• We may adjust, limit, reset, or remove virtual items where necessary to operate, secure, or improve the app.

6. Purchases and Subscriptions

• Nova may offer optional purchases through Google Play, including Pro membership, ad removal, and in-app currency.
• All payment processing is handled exclusively through Google Play Billing. No third-party purchase management services are used.
• Refund requests are handled according to Google Play policies.
• Pro membership may include benefits such as ad removal, premium customization options, or other premium features described in the app.
• Prices, features, and availability may change over time.

7. Prohibited Conduct

You agree not to:

• Use bots, scripts, exploits, automation, or unauthorized tools to manipulate progress, quests, rankings, rewards, Nova Points, or app data.
• Fake activity, abuse systems, or attempt to farm rewards dishonestly.
• Reverse engineer, decompile, modify, hack, or attempt to access Nova's code, systems, database, or backend services without authorization.
• Use offensive, abusive, misleading, harassing, or inappropriate names, profile content, or social behavior.
• Interfere with the security, stability, or normal operation of Nova.
• Use Nova for unlawful, harmful, or unauthorized purposes.

8. Social Features and User Content

Nova may allow users to display names, public profiles, streaks, progress, rankings, friend information, or other app-related stats.

You are responsible for the information you choose to display. We may remove, restrict, or moderate content or accounts that violate these Terms or harm other users.

9. Intellectual Property

Nova, including its name, branding, logo, designs, interface, visuals, quest structures, rewards, features, and related content, is owned by or licensed to NOVASTORE (PTY) LTD.

You may not copy, reproduce, distribute, modify, or use Nova's intellectual property without written permission from NOVASTORE (PTY) LTD.

10. Service Availability and Updates

We aim to keep Nova available and working reliably, but we do not guarantee that the app will always be uninterrupted, error-free, or available on every device.

We may update, modify, suspend, or discontinue parts of Nova where needed for maintenance, security, improvements, or business reasons.

11. Account Deletion and Termination

You may delete your account and data at any time through the app by going to Settings, then Danger Zone, then Delete Account.

We may suspend or terminate access to Nova if you violate these Terms, abuse the app, compromise security, or use the service in a harmful or unlawful way.

12. Limitation of Liability

To the maximum extent permitted by law, NOVASTORE (PTY) LTD will not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of progress, loss of rewards, service interruptions, device issues, personal injury, or health-related consequences arising from your use of Nova.

13. Disclaimer of Warranties

Nova is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we make no warranties that Nova will meet your expectations, achieve specific fitness results, be uninterrupted, or be error-free.

14. Governing Law

These Terms are governed by the laws of the Republic of South Africa, without regard to conflict of law principles.

15. Changes to These Terms

We may update these Terms from time to time. Updates will be posted on this page with a revised date. Continued use of Nova after updates means you accept the updated Terms.
